1. Acceptance of Terms

By accessing or using the listnr platform ("Service") operated by Playlistn Ltd ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

listnr is an A&R discovery and analytics platform that helps music industry professionals discover emerging artists, monitor playlists, track artist development, and manage their talent pipeline. The Service integrates with third-party music platforms and data providers to deliver insights and analytics.

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activity under your account

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to the Service or its systems
  • Scrape, crawl, or use automated means to access the Service beyond the provided API
  • Interfere with or disrupt the Service or its infrastructure
  • Resell, redistribute, or sublicence access to the Service without our written consent
  • Use the Service to infringe on any third party's intellectual property rights

5. Third-Party Platform Data

The Service accesses data from third-party music platforms (e.g. Spotify) and data providers (e.g. Chartmetric) through their official APIs. Your use of the Service is also subject to the terms of service of these third-party platforms. We are not responsible for the accuracy, availability, or completeness of third-party data.

6. Intellectual Property

6.1 Our Content

The Service, including its design, features, and underlying technology, is owned by Playlistn Ltd and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content without prior written consent.

6.2 Your Content

You retain ownership of any content you submit to the Service (e.g. notes, tags, pipeline data). By using the Service, you grant us a limited licence to store and process your content as necessary to provide the Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice. Scheduled maintenance will be communicated in advance where possible.

9. Limitation of Liability

To the maximum extent permitted by law, Playlistn Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or available at all times. Analytics, insights, and recommendations are provided for informational purposes only and should not be relied upon as the sole basis for business decisions.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with reasonable notice where possible. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ireland.
